By using this website and engaging with Tina Somerville’s graphic design services, you agree to the following Terms and Conditions. Please read these carefully before proceeding with any services.


1. Services Provided

Tina Somerville provides graphic design services, including but not limited to logo design, branding, digital and print design, marketing collateral, and consultancy services. All work is carried out based on an agreed scope, schedule, and pricing discussed before the start of any project.

2. Quotations and Pricing

All prices for design services are quoted in New Zealand Dollars (NZD). Prices are based on the scope of work provided at the time of the quote and are subject to change if the project scope changes. Additional services or revisions beyond the agreed scope may incur additional charges.

3. Payment Terms

  • A non-refundable deposit of 50% of the total project fee is required before work commences.

  • The remaining 50% is due upon completion of the project and before the final delivery of files.

  • For smaller projects, full payment upfront may be required.

  • Payment terms for larger or ongoing projects can be discussed and arranged on a case-by-case basis.

  • Payment methods accepted include bank transfer and other specified online payment systems.

4. Revisions and Changes

  • The client is entitled to a set number of revisions as specified in the project agreement. Additional revisions beyond this will be charged at the agreed hourly rate.

  • Any changes requested after final approval will be treated as a new project and billed accordingly.

5. Project Timelines

All project timelines are estimates unless otherwise stated. While Tina Somerville will strive to meet deadlines, unforeseen circumstances may occasionally cause delays. Clients will be notified of any significant changes to the project timeline.

6. Intellectual Property

  • Upon receipt of full payment, the client is granted ownership of the final design files and the right to use them as agreed in the project contract.

  • All preliminary work, including drafts, sketches, or rejected designs, remain the intellectual property of Tina Somerville unless otherwise agreed in writing.

  • Tina Somerville reserves the right to display completed projects in her portfolio, on her website, and on social media unless a prior agreement prevents this.

7. Cancellation Policy

If the client decides to cancel the project after it has commenced:

  • The 50% deposit will not be refunded.

  • If significant work has been completed beyond the deposit amount, the client will be billed for any additional work completed up until the cancellation.

8. Client Responsibilities

The client agrees to provide timely feedback, approvals, and any necessary materials (e.g., logos, content, brand guidelines). Delays in providing this information may result in project timeline extensions.

9. Liability

Tina Somerville is not liable for any damages or loss of profit incurred by the client due to the use of any designs or services provided. The client is responsible for proofreading and approving all final designs. Once the design is approved, any errors, including typographical errors, are the responsibility of the client.

10. Confidentiality

All client information and materials provided are treated as confidential unless explicitly stated otherwise. Confidential materials will not be shared or used outside the project scope without the client’s permission.

11. Third-Party Services

Any third-party costs (such as printing, stock imagery, or web hosting) will be billed directly to the client. Tina Somerville is not responsible for the performance or pricing of third-party services but will assist in coordinating with vendors as part of the design process.

12. Amendments

Tina Somerville reserves the right to update these Terms and Conditions at any time. Clients will be notified of significant changes to these terms. Continued use of services after changes have been made constitutes acceptance of the new terms.

13. Governing Law

These Terms and Conditions are governed by the laws of New Zealand. Any disputes arising under these terms will be settled under New Zealand jurisdiction.
